Terms of Service

These Terms of Service ("Terms") govern your use of the DealVibe platform, operated by DealVibe.ai ("DealVibe," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.

1. What DealVibe Is

DealVibe is a powerful, end-to-end platform that helps creators manage brand deal inquiries, negotiate terms, and get paid — and then produces the digital content and advertisements or marketing assets a deal calls for, built to the brand's spec. DealVibe is not a party to the underlying deal between you and a brand — we provide tools to help you communicate, negotiate, formalize terms, and create the deliverables, but the resulting agreement is between you and the brand.

2. AI-Assisted Negotiation

DealVibe's AI-assisted negotiation feature drafts message responses and suggested terms based on the context of your conversation and the preferences you set. It is not autonomous — every draft is presented to you for review, and nothing is sent to a brand without your action. You are responsible for reviewing AI-generated drafts before sending them, and for the terms you ultimately agree to.

3. Eligibility and Accounts

You must be at least 18 years old to use the Service. You're responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly at info@dealvibe.ai if you suspect unauthorized use.

4. Payments and Payouts

All payments and creator payouts are processed through Stripe, a third-party payment processor. DealVibe does not manage, custody, or hold your funds at any point — payouts are sent automatically and directly to your own Stripe account under Stripe's own terms and payout schedule. By providing payment information, you authorize us and Stripe to charge the applicable fees. Payout timing and any thresholds are set by Stripe and described in the Service at the time of payout.

5. Content Ownership

You retain ownership of the content you create using the Service — including negotiation messages, deal terms, and generated video or voiceover content. By using the Service, you grant DealVibe a limited license to host, process, and transmit that content solely as needed to provide the Service to you.

6. Disclosure Obligations

If you use DealVibe to negotiate or manage sponsored content deals, you are solely responsible for complying with applicable advertising disclosure requirements — including the FTC's endorsement guidelines in the United States and the ASA's rules in the United Kingdom, or the equivalent regulator in your jurisdiction. DealVibe does not review or guarantee compliance of your disclosures.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Misrepresent your identity or affiliation, or impersonate another person or brand.
• Attempt to interfere with, disrupt, or gain unauthorized access to the Service or its underlying systems.
• Use the Service to harass, defraud, or deceive any brand, creator, or other user.
• Reverse-engineer, scrape, or resell the Service without our prior written consent.

8. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that AI-generated drafts will be error-free, that any brand deal will close, or that the Service will be uninterrupted or error-free.

9. Limitation of Liability

To the maximum extent permitted by law, DealVibe will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data, arising from your use of the Service. Our total liability for any claim arising from these Terms or the Service is limited to the amount you paid us in the twelve months preceding the claim.

10. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your account if you violate these Terms, or as needed to protect the Service, other users, or DealVibe. Sections of these Terms that by their nature should survive termination — including content ownership, disclaimers, and limitation of liability — will continue to apply.

11. AI Features and Agentic Actions

When you configure DealVibe to negotiate, draft, or create content on your behalf, DealVibe acts as your authorized agent, taking those actions under the permissions, budgets, and preferences you set ("Agentic Actions"). You're responsible for configuring those settings, for reviewing what DealVibe does under them, and for the outputs you choose to send or publish.

AI-generated content and Agentic Actions can be incomplete, inaccurate, or inappropriate even when they appear polished or specific — review everything before relying on, sending, or publishing it. DealVibe is not a law firm, financial advisor, tax advisor, or other licensed professional; don't treat generated content, negotiated terms, or Agentic Actions as a substitute for qualified advice on legal, financial, tax, or regulatory questions. Where the Service incorporates or links to third-party content or services, DealVibe doesn't warrant their accuracy and isn't responsible for them. If you use DealVibe's content in an advertising campaign, you're responsible for that content's compliance with the relevant ad platform's own policies.

12. Changes to These Terms

We may update these Terms from time to time. We'll post the updated version here with a new effective date, and where changes are material, we'll provide additional notice.
